Returns & Refunds

These General Terms and Conditions of Sale (hereinafter, "General Conditions") govern the remote purchase of products via the electronic network from the website (hereinafter, the "Website"). The Owner of the Website is My Mind Srl (hereinafter, "numero00"), VAT number 04128720408.

Acceptance of the General Conditions of Sale

All purchases of products made through the Website (hereinafter, "Purchase Contracts") by users who access it (hereinafter, "Customers") are regulated by these General Conditions, as well as by the Italian Consumer Code (Legislative Decree no. 206/2005), Section II Remote Contracts (Articles 50 – 67), and by the regulations on electronic commerce (Legislative Decree 70/2003).

By concluding the purchase contracts according to the standard procedure, the Customer accepts and undertakes to observe these General Conditions. Therefore, the Customer is invited to read these General Conditions carefully before making any purchase transaction and, once the purchase procedure provided by the Website is concluded, to print them or otherwise save them according to their preferred method.

My Mind Srl may modify the content of these General Conditions at any time and without prior notice. The General Conditions applied to the Purchase Contracts shall be those published on the Website at the time the Customer submits the purchase order.

Products

Online e-commerce website for the sale of clothing. All offered products are illustrated in detail on the homepage of the Website, within their respective sections and divided by product categories.

The visual representation of the products on the Website, where available, normally corresponds to the photographic image of the products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment by My Mind Srl regarding the exact match between the image shown on the Website and the actual product. In the event of any discrepancy between the image and the written product sheet, the description on the product sheet shall always prevail.

Purchase Procedure

The Customer can purchase the products present in the Numero 00 electronic catalog, detailed on the homepage of the websitere within the respective sections by product category, as described in the relevant information sheets contained on the Website, respecting the technical access procedures illustrated therein.

The publication of the products displayed on the Website constitutes an invitation to the Customer to formulate a contractual purchase proposal. The order sent by the Customer is considered a contractual proposal and implies full knowledge and complete acceptance of these General Conditions.

The correct receipt of the Customer's proposal is confirmed by My Mind Srl through an automatic response sent to the e-mail address provided by the Customer; this message only confirms the correct receipt of the proposal within the information systems. This confirmation message will indicate an "order number", to be used in any subsequent communication with My Mind Srl.

The message will contain, in addition to the information required by law, all the data entered by the Customer, who undertakes to verify its correctness and to promptly communicate any corrections. Any additional costs caused by errors in the data that were not promptly reported shall be borne exclusively by the Customer.

Each order can be viewed by the Customer on the Website in their personal area immediately after submission and can be canceled until it is sent to the warehouse for preparation.

Occasional unavailability of the offered products may occur. In this case, if the products chosen by the Customer are not available in whole or in part, the order will be shipped with the available products after notifying the Customer regarding the unavailable items.

Payments made via Credit Card and PayPal exclusively require an authorization (see payment methods), which is a reservation of funds without an actual charge at the moment the Customer places the order. Therefore, the payment is only actually charged to the Customer when the products are delivered to the courier in charge of shipping. At this stage, My Mind Srl will also issue the invoice relating to the order. This implies that in case of order cancellation by the Customer (via the reserved area or through a request to customer service), no amount will be charged, and consequently, Numero 00 will not have to issue any refund.

Each purchase contract stipulated between My Mind Srl and the Customer is considered concluded only upon acceptance of the order by My Mind Srl. My Mind Srl has the right to accept or reject, at its discretion, the order sent by the Customer, without the latter being able to advance claims or rights of any kind, for any reason, including compensation, in case of non-acceptance of the order.

In particular, My Mind Srl reserves the right not to accept purchase proposals and to cancel orders that do not provide sufficient guarantees of solvency or if—even after consultation with the credit card payment management circuit—anomalies appear in the transactions and payment methods used by the Customer. Order confirmation is given to the Customer at the moment the products are delivered to the courier in charge of shipping, with the simultaneous issuance of the invoice.

Product Prices

All product prices are clearly indicated on the Website. Delivery costs are appropriately highlighted at the time of the order.

Delivery Methods

My Mind Srl delivers to all countries indicated on the Website, and delivery will take place without an appointment. The cost and delivery times vary based on the place of delivery:

  • In Italy: The shipping cost is € 6, with estimated delivery times of around 24/48 hours (shipping is free for orders equal to or greater than € 150).

  • In Europe: The shipping cost is € 11 / € 17, with estimated delivery times of around 3/5 working days.

  • Rest of the World: The shipping cost is € 36 / € 51, with estimated delivery times of around 6/7 working days.

My Mind Srl issues an invoice for the purchased products at the moment they are delivered to the courier for shipping, sending it via e-mail to the Customer. The information provided by the Customer shall be valid for the issuance of the invoice. No changes to the data will be possible after the invoice has been issued.

No liability, for any reason, can be charged by the Customer to My Mind Srl in the event of a delay in processing the order or in delivering the products covered by the Purchase Contracts.

The ordered products will be sent to the postal address specified by the Customer. Deliveries will be made from Monday to Friday, during normal business hours, excluding national holidays. Delivery is deemed completed at the moment the product is made available to the Customer at the address specified in the order form.

In case of non-delivery due to the absence of the recipient at the specified address, the courier will send a notification email and will attempt delivery the following day. If delivery is still impossible the next day due to the absence of the recipient, Customer Service will attempt to contact the Customer to schedule a new delivery. If Customer Service is unable to contact the Customer for the following 10 days, or in case of further impossibility of delivery due to the recipient's absence, the ordered products will be returned to My Mind Srl.

Upon delivery of the products by the courier appointed by My Mind Srl, the Customer is required to carefully check:

  1. That the anti-tampering label is intact and the packaging is not damaged or otherwise altered.

  2. That the number of items delivered corresponds to what is indicated in the transport document.

Any damage to the anti-tampering label, packaging, or products, or a mismatch in the number of pieces/packages or indications, must be immediately contested by the Customer, who can contact My Mind Srl through Customer Service, specifying the order for which these issues occurred.

Cases of force majeure, unavailability of means of transport, as well as unpredictable or unavoidable events causing a delay in deliveries or making deliveries difficult or impossible, or causing a significant increase in delivery costs for My Mind Srl, will entitle the company to split, postpone, or cancel, in whole or in part, the scheduled delivery or to terminate the Purchase Contract. In such cases, My Mind Srl will provide prompt and adequate communication of its decisions to the e-mail address indicated by the Customer, and the latter will be entitled to a refund of any price already paid, excluding any further claims of any kind against My Mind Srl.

RETURNS & REFUNDS

Our operators will assist you in handling return cases for size exchanges or possible refunds. The return request cannot exceed 14 working days.

Payment Methods

Payment for the purchased products can be made using the following methods:

  • Credit Card: Purchases can be made using Visa, Mastercard, and PostePay.

  • PayPal: By choosing the PayPal payment method, the Customer can pay directly through their PayPal account. My Mind Srl reserves the right to ship the goods exclusively to the address indicated on the verified PayPal account.

  • Apple Pay: Customers can choose to pay through their Apple Pay account.

  • Klarna: Customers can choose to pay the full amount of their order via the Klarna service.

Right of Withdrawal are regulated by these General Conditions as well as by Italian law on mail-order/distance sales. Pursuant to Art. 64 et seq. of Legislative Decree 206/2005 (Consumer Code), the consumer Customer (meaning a natural person who purchases goods for purposes not related to their professional activity, i.e., without indicating a VAT number) has the right to withdraw from the purchase contract for any reason and without providing explanations, under the conditions set out below.

 

To exercise this right, the Customer must send a communication to this effect, by registered mail with return receipt (raccomandata R/R), within 14 (fourteen) working days from the date of receipt of the goods.

The substantial integrity of the product to be returned is an essential condition for exercising the right of withdrawal. It is, however, sufficient for the item to be returned in a normal state of preservation.

Once the integrity of the returned product has been verified, My Mind Srl will refund the Customer the full amount paid for the products covered by the withdrawn Purchase Contract, no later than 30 (thirty) days from the return of the products. My Mind Srl will refund the full value of the order (or part of it if the withdrawal is partial) via bank transfer or through other methods specifically agreed upon between My Mind Srl and the Customer. It is specified that, in accordance with current regulations on the matter, My Mind Srl will refund the sums paid by the Customer as the price of the products. The costs necessary for returning the products to My Mind Srl shall be borne entirely by the Customer.

Product Non-Conformity or Faulty Products

The products offered on the Website comply with the national and EU legislation currently in force in Italy. The images and colors of the products published on the Website may differ from the real ones due to the local settings of the systems and/or tools used for their visualization.

In the event of a lack of conformity of the purchased products compared to the description published on the Website, or in the case of a broken or defective product, the Customer has the right to a refund or replacement of the non-conforming item. This will be followed by a communication from the My Mind Srl staff indicating the refund method, which could also take place through discount vouchers on the next purchase with a value higher than the goods to be refunded, excluding any further liability of My Mind Srl for any reason.

Processing of Personal Data

Customer data is processed by My Mind Srl in compliance with current legislation on personal data protection, as specified in the information notice present in the dedicated section called "Privacy Policy".

Communications and Complaints

All communications or any complaints by the Customer against My Mind Srl regarding Purchase Contracts must be submitted through the appropriate contact forms present within the Reserved Area.

Intellectual Property Rights

All trademarks (registered or unregistered), as well as any and all intellectual works, distinctive marks or names, images, photographs, written or graphic text, and more generally any other intangible asset protected by international laws and conventions on intellectual property and industrial property reproduced on the Website remain the exclusive property of My Mind Srl and/or its predecessors, without the Customer deriving any rights over them from accessing the Website and/or stipulating Purchase Contracts. Any use, even partial, of the same is prohibited without the prior written authorization of My Mind Srl and/or its predecessors, in whose exclusive favor all related rights are reserved.

Jurisdiction (Competent Forum)

Any disputes relating to the interpretation and execution of contracts stipulated in compliance with these General Conditions will be resolved before the competent judicial authority based on applicable legislation in the case of "Consumer" Customers, whereas for "Professional" Customers (business users), the exclusive competent forum will be the Court of Rimini.
